TERMS AND CONDITIONS OF jenniferlgreen.com, also known as JLG Retouching, SERVICES

  1. DEFINITIONS

1.1. "Client" refers to the individual or organisation that commissions JLG Retouching to provide retouching services.
1.2. "Services" refers to the retouching services provided by JLG Retouching to the Client.
1.3. "Project" refers to the specific retouching project commissioned by the Client.
1.4. "Deliverables" refers to the final retouched images provided to the Client.

  1. SCOPE OF WORK

2.1. JLG Retouching agrees to provide retouching services to the Client as outlined in the Project proposal.
2.2. The Client is responsible for providing JLG Retouching with all necessary information, materials, and assets required to complete the Project.
2.3. JLG Retouching reserves the right to refuse any Project that it deems inappropriate, offensive, or illegal.

  1. PAYMENT TERMS

3.1. The Client shall pay JLG Retouching the agreed-upon fee for the Services as outlined in the Project proposal.
3.2. Payment is due upon receipt of the invoice, unless otherwise agreed upon in writing.

  1. COPYRIGHT AND OWNERSHIP

4.1. The Client retains all copyright and ownership rights to the original images provided to JLG Retouching.
4.2. JLG Retouching retains all copyright and ownership rights to the retouched images created as part of the Services.
4.3. The Client is granted a non-exclusive license to use the retouched images for the purpose outlined in the Project proposal.

  1. CONFIDENTIALITY

5.1. JLG Retouching shall maintain the confidentiality of all Client information and materials provided during the Project.
5.2. The Client shall maintain the confidentiality of all JLG Retouching proprietary information and trade secrets.

  1. WARRANTIES AND REPRESENTATIONS

6.1. JLG Retouching warrants that the Services will be performed with reasonable skill and care.
6.2. The Client warrants that it has the necessary rights and permissions to provide JLG Retouching with the original images and to use the retouched images for the intended purpose.

  1. LIMITATION OF LIABILITY

7.1. JLG Retouching shall not be liable for any damages or losses arising from the Services, except to the extent caused by its gross negligence or wilful misconduct.
7.2. The Client shall indemnify and hold harmless JLG Retouching against any claims, damages, or losses arising from the Client's breach of these Terms and Conditions.

  1. TERMINATION

8.1. Either party may terminate the Project upon written notice to the other party.
8.2. Upon termination, JLG Retouching shall deliver all completed work to the Client and the Client shall pay JLG Retouching for all work completed prior to termination.

  1. GOVERNING LAW

9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain.
9.2. Any disputes arising from these Terms and Conditions shall be resolved through an appropriate court of the United Kingdom of Great Britain.

  1. ENTIRE AGREEMENT

10.1. These Terms and Conditions constitute the entire agreement between the parties and supersede all prior negotiations, understandings, and agreements.
10.2. These Terms and Conditions may not be amended or modified except in writing signed by both parties.

   11. LANGUAGE

11.1 All communication, emails, quotes, terms and conditions, will be conducted in English.

By commissioning JLG Retouching to provide retouching services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
